Acceptance of Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you and Thrive for Longevity, Inc. (“Thrive for Longevity,” “we,” “our,” or “us”) governing your access to and use of thriveforlongevity.org (the “Site”) and all content, features, and services available on or through the Site.

By accessing or using the Site, you confirm that (a) you are at least 18 years old; (b) you have the legal authority to enter into these Terms; and (c) you agree to be bound by these Terms. Use of the Site constitutes acceptance (“browsewrap” acceptance). Where we require explicit assent (such as event registration or donation checkout), your affirmative action constitutes additional confirmation of acceptance.

About Thrive for Longevity

Thrive for Longevity is a nonprofit public charity providing women’s health education focused on perimenopause, menopause, and longevity. All content on this Site is editorial, educational, and evidence-based. Thrive for Longevity is not a healthcare provider, medical clinic, or insurer.

Intellectual Property

Our Content

All content on this Site, including but not limited to text, articles, essays, graphics, photographs, logos, video, audio, and the overall design and organization of the Site (collectively, “Content”), is owned by or licensed to Thrive for Longevity and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content, except as follows:

  • You may print or download a reasonable number of pages for personal, non-commercial use
  • You may share links to our content on social media for non-commercial purposes
  • Healthcare providers may use limited portions of our educational content in non-commercial patient education settings, with attribution to Thrive for Longevity

Trademarks

“Thrive for Longevity,” “On Her Terms,” the TFL logo, and other marks displayed on this Site are trademarks of Thrive for Longevity, Inc.. Nothing in these Terms grants you any right to use our trademarks without our prior written consent.

User-Submitted Content

If you submit any content to us through contact forms, partnership inquiries, or otherwise (collectively, “Submissions”), you grant Thrive for Longevity a non-exclusive, royalty-free, perpetual, irrevocable, worldwide right to use, reproduce, and incorporate your Submissions in our operations and communications, solely for the purposes for which you submitted them. You represent that your Submissions do not infringe any third-party intellectual property rights and that you have the right to grant the foregoing license.

Events and Programs

Registration

Event registration and ticket purchases are subject to the specific terms presented at the time of registration, including event capacity limitations, eligibility requirements, and any program-specific guidelines. By registering for an event, you agree to abide by TFL’s event code of conduct described in Section 9.

Cancellations and Refunds
  • Event Tickets: Full refund available up to 7 days before the event date. Refunds requested between 7 days and 48 hours before the event will be issued as a credit toward a future Thrive event. No refunds within 48 hours of the event, except in cases of event cancellation by Thrive, in which case all ticket holders receive a full refund automatically.
  • Programs: (multi-session programs such as Know Your Numbers and Book Circle): For programs requiring upfront payment, members may cancel within 14 days of enrollment for a full refund. After 14 days, refunds are prorated based on sessions remaining, less a 15% administrative fee. Members may request to transfer their enrollment to a future cohort in lieu of a refund.
  • Donations: All donations to Thrive for Longevity, Inc. are final and considered tax-deductible to the extent permitted by law. Refund requests for donations made in error must be submitted within 30 days of the donation date to hello@thriveforlongevity.org with the transaction details. Thrive will review such requests in good faith but is under no obligation to refund completed charitable contributions. Donation refund contact email: hello@thriveforlongevity.org

Event Photography and Recording

TFL events may be photographed or recorded for educational and promotional purposes. By attending a TFL event, you consent to your likeness being included in such photographs or recordings. If you have specific concerns, please notify TFL staff at the event.

Donations

Donations made through our Site are processed by Stripe. By making a donation, you confirm that:

  • You are the authorized user of the payment method provided
  • You understand that donations to Thrive for Longevity, Inc. (EIN 39-4883805) are tax-deductible to the extent permitted by law
  • Donation amounts and donor information will be retained as required by nonprofit tax and recordkeeping laws
  • A donation acknowledgment will be emailed to the address provided. Thrive for Longevity is
    registered with the Florida Division of Consumer Services (Reg# CH80847).

User Conduct

You agree not to use this Site to:

  • Violate any applicable federal, state, or local law or regulation
  • Transmit any content that is unlawful, defamatory, obscene, harassing, or threatening
  • Infringe any intellectual property or other proprietary rights
  • Transmit unsolicited commercial communications (“spam”)
  • Attempt to gain unauthorized access to any portion of the Site or its related systems or networks
  • Introduce any virus, malware, spyware, or other harmful code
  • Use the Site for any commercial purpose without our prior written consent
  • Collect or harvest personal information of other users
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

Third-Party Links and Services

Our Site contains links to third-party websites and may embed content from third-party platforms. These links and embedded services are provided for your convenience. We do not control and are not responsible for the content, privacy practices, or terms of third-party sites or services.

Specific third-party services integrated with our Site include Stripe, Mailchimp, Luma, Substack, Google Analytics, and others described in our Privacy Policy. Your use of those services is governed by their respective terms and policies.

Community Standards and Code of Conduct

Thrive for Longevity cultivates a respectful, evidence-based community. All participants in TFL programs, events, and online activities are expected to:

  • Treat all participants, staff, and speakers with dignity and respect
  • Engage with health information responsibly and without providing personal medical advice to other participants
  • Refrain from harassment, discrimination, or conduct that creates a hostile environment
  • Follow facilitator and staff direction during events

TFL reserves the right to remove any participant from events or programs who violates these standards, without refund, at TFL’s sole discretion.

Disclaimers and Limitation of Liability

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THRIVE FOR LONGEVITY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be available, uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THRIVE FOR LONGEVITY, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON ANY CONTENT.

OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU PAID TO TFL IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Indemnification

You agree to defend, indemnify, and hold harmless Thrive for Longevity and its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

Essential Basis of Bargain

The disclaimers and limitations of liability set forth in this Section 10 reflect a reasonable allocation of risk between the parties and are an essential element of the basis of the bargain between you and Thrive for Longevity. Thrive for Longevity would not provide access to the Site without these limitations.

Future Membership and Gated Content

Thrive for Longevity may in the future offer members-only content, gated programming, or online community features (“Membership Features”). If and when Membership Features are made available, additional terms governing account creation, member benefits, payment, and cancellation will be provided and will supplement these Terms. Use of any Membership Features will constitute acceptance of those additional terms.

Privacy

Your use of the Site is also governed by our Privacy Policy, located at thriveforlongevity.org/privacy-policy, which is incorporated into these Terms by reference.

Termination of Access

Thrive for Longevity reserves the right to suspend or terminate your access to the Site at any time, without notice, for conduct that violates these Terms or is otherwise harmful to other users, TFL, or third parties, or for any other reason at our sole discretion. Upon termination, all licenses granted to you under these Terms immediately terminate.

Governing Law and Dispute Resolution

Governing Law

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Jurisdiction

You consent to the exclusive jurisdiction of the state and federal courts located in Palm Beach County, Florida for resolution of any dispute arising under or related to these Terms. You waive any objection to such courts on the basis of inconvenient forum.

Dispute Resolution

The parties agree to first attempt to resolve any dispute informally by contacting Thrive for Longevity at hello@thriveforlongevity.org. If no resolution is reached within 60 days of written notice, either party may bring an action in the state or federal courts located in Palm Beach County, Florida, which shall have exclusive jurisdiction over any such dispute.

Before filing any legal claim, you agree to provide Thrive for Longevity with written notice of the dispute at hello@thriveforlongevity.org and a reasonable opportunity of at least 30 days to resolve the matter informally. Both parties agree to negotiate in good faith during this period.

Class Action Waiver

To the extent permitted by law, you agree that any disputes will be resolved on an individual basis only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

We have implemented the UserWay accessibility widget and are working toward conformance with Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. Children

This Site is intended for users who are 18 years of age or older. We do not knowingly permit children under the age of 13 to use our Site or submit personal information.

Modifications to These Terms

We may revise these Terms at any time. When we do, we will update the “Last Reviewed” date at the top of this page. Material changes will be communicated by posting a notice on the Site. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Thrive for Longevity with respect to your use of the Site.
  • Severability: If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force.
  • No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
